Penalties for Drinking & Driving

First Offence Conviction Consequences

  • a minimum fine of $600.00
  • a minimum one-year driving prohibition period
  • possible period of probation

Second Offence Conviction Consequences

  • a minimum jail sentence of 14 days
  • a minimum two-year driving prohibition period (a minimum of three-year suspension if the prior conviction was within the past 10-year period)
  • possible period of probation

Third Offence Conviction Consequences

  • a minimum jail sentence of 90 days
  • a minimum three-year driving prohibition period to a maximum of a life-time suspension
  • possible period of probation

Fourth Offence or More Conviction Consequences

  • a jail sentence in excess of 90 days
  • permanent suspension in the Province of Ontario
  • possible period of probation
